- The tenant must carry out the following work to the premises, which must be completed by Monday, 1 June 2026: a. Remove any car wrecks and car tyres; b. Remove all temporary fencing; c. Remove all scrap metal; d. Removal all rubbish and wood from the exterior of the premises.
- If the tenant fails to comply with either Order 1 above, then the landlord may undertake the work and charge the tenant the costs of this work up to $3,764.25. This estimate is based on the photographs taken at the premises on 14 May 2026. These costs may be treated as rent in arrears and enforced accordingly.
Reasons
- Both parties attended the hearing. The landlord attended by video and the tenant attended by telephone.
- The landlord claims that the tenant has breached the tenancy agreement 1 and the Residential Tenancies Act 1986 2 by failing to keep the exterior of the premises reasonably clean and tidy. The landlord wants the problem fixed.
- Under section 40(1)(a)-(e), Residential Tenancies Act 1986, a tenant has specific obligations in relation to the tenancy premises.
- Where the Tribunal finds the tenant has failed to comply with any of these obligations, where appropriate it may make an order for the landlord to carry out the work. See section 78(1)(e) Residential Tenancies Act 1986.
- A work order may also authorise the landlord to undertake the work and charge the tenant the costs of doing the work, if the tenant should fail to comply with the work order and alternative monetary order. A monetary limit must be imposed by the Tribunal on the amount of costs that can be charged. These costs can be treated as rent in arrears and enforced accordingly. See sections 78(2AAB) and 78(2AAC)(a) Residential Tenancies Act 1986.
Has the tenant failed to comply with their obligations?
- The landlord has produced photographs showing that the exterior of the premises is not reasonably clean and tidy. A further report was filed with photographs taken on 14 May 2026 which show improvement as the tenant has taken some steps.
- The tenant says that the scrap metal will be removed this week, and he will be able to remove the remaining inorganic rubbish by 1 June 2026.
- The landlord has an estimate to carry out the work based on the photographs taken on 14 May 2026. If the landlord needs to carry out the work the cost will likely be less than the estimate given that the tenant says he has carried out some work since those photographs were taken and further work is planned for the next two weeks.
