Tenancy Tribunal case 4506309 — Rent arrears
Decided 17 Nov 2023 · Published 17 Nov 2023 · Application 4506309
- Rent arrears
Party names are redacted in the official published order.
Order
- An application for suppression has been made in this case, and the Tribunal orders suppression of the Landlord’s name and identifying details.
- Moealofa Savaiki and Savaiki Iosefatu Alefaio must pay [The landlord/s] $669.88 on or before 15 April 2023, as set out in the table below.
Reasons
- Both parties attended the hearing.
- The landlord initially applied for termination on the basis of arrears that were substantial. Since the application was filed, the tenant has made significant payments and the amount owing for rent arrears is now reduced to $524.27.
- The landlord's evidence was that it has issued weekly 14 day notices, although those notices were not before the tribunal. The tenant advised that her husband now has secure employment and that payment of rent will not be an issue going forwards.
- Given the amount currently owing is now low, the landlord accepts that an order can simply be made that the tenant pays the sum owing by 15 April 2023. The tenant understand that she must pay this amount owing on time, as well understanding the need for ongoing compliance with rent payments.
- Because [The applicant/s] has substantially succeeded with the claim, I have reimbursed the filing fee.
