- The application is dismissed.
Reasons
- Neither party attended the hearing.
- This matter had been adjourned from a previous hearing held on 24 July 2023. Neither party attended that hearing, nor did they advise the Tribunal or seek an adjournment.
- Shortly before the start of the hearing today Amy Li for the landlord sent an email to the Court Registry advising that she is overseas and suffering from Covid and could not attend the hearing today. I noted that Ms Li had not sought to attend the hearing by phone but directed that she could attend by phone so that the hearing could still proceed today.
- The tenant, who is the applicant in this matter, was not present when the case was called at 9.30am. I have waited until 9.45 to ensure that the tenant has not been delayed.
- The tenant did not attend the hearing at the scheduled time, request an adjournment, or notify the Tribunal the matter has settled. See sections 78(1)(i) and 92(1) Residential Tenancies Act 1986.
- The tenant’s claim is dismissed.
