Mr Grant provided me with a copy of correspondence between him and Mr Halse (the Applicant’s representative) dated yesterday’s date where Mr Halse informs Mr Grant that he is unwell and intends to seek an adjournment. Mr Grant opposes an adjournment on the basis that his client has incurred significant costs in preparing for today’s hearing and has flown its representative and witness (Mr Young) up from Christchurch.

The Tribunal has not received an application for an adjournment from Mr Halse. Further Mr Wilson, who is the named applicant did not attend the hearing. It appears from correspondence between the parties that Mr Wilson now resides in the South Island and was not planning on attending today’s hearing.

As the Applicant has not sought an adjournment, and as Mr Wilson did not attend, then the applicants claims is dismissed.

The Tribunal can order a party to pay reasonable costs to the other party where: the Tribunal believes the claim is frivolous or vexatious, any of the parties are represented by a lawyer, the claim should have been settled at mediation, or the applicant has failed to attend the hearing without reasonable excuse. See section 102(2),(3)(b) Residential Tenancies Act 1986.

I am satisfied that costs should be awarded in this case in favour of the Respondent. Mr Grant is to provide a written memorandum to the Tribunal and the other party setting out the costs sought by the 16 October 2023. If Mr Wilson wishes to make any objection to these costs, then he should put those objections in writing to the Tribunal and Mr Grant no later than the 23 October 2023, after which time I will make a costs award in writing.
