Both parties attended the hearing by telephone.

The Landlord was agitated, unruly and intimidating. I perceived he was unsettled about the hearing, and his behaviour may have been a nervous reaction to the hearing getting underway. It was nevertheless inexcusable.

In the course of hearing from the parties, I discerned there were multiple individuals living at the premises, and multiple tenancy agreements, I could not be sure how many exactly, but the Tenant confirmed more that six (6) people were living at the premises, which included a garage and outhouse of some description, with all individuals sharing amenities.

It was very hard to establish just what the arrangements were because the Landlord was obstructive and would not answer questions. When I asked about the arrangements he told me, “...nah, we don’t need to get into that,” and he asked why I was “going off track”. Hole in wall

There is a hole in wall. The Landlord claims the Tenant accepted responsibility for the hole in the wall because her father helped to repair it. He says the Tenant must pay the cost of repainting the wall.

The Tenant says she was not at the home when the damage occurred, but her then-partner was. Her father offered to repair it for free.

Section 66L of the Residential Tenancies Act states: Tenant’s liability for damage caused by others (1) The tenant of a boarding house is responsible for anything done or omitted to be done by any person who is on the premises with the tenant’s permission if the act or omission would have constituted a breach of the tenancy agreement had it been the act or omission of the tenant. (2) Any damage done to a tenant’s boarding room is presumed to have been caused by the tenant, unless the tenant proves otherwise or is not the only tenant of that room. (3) For the purposes of subsection (2), a person who enters the tenant’s boarding room is presumed to be on the premises with the tenant’s permission, unless the tenant proves otherwise or is not the only tenant of that room.

The damage did not occur in the Tenant’s room.

The applicant has not satisfied me that it is more likely than not that the Tenant is responsible for the hole.
