Order

An application for suppression has been made in this case, and the Tribunal orders suppression of the landlord’s name and identifying details.
By consent, the tenancy of Parewhakairiangarangi Kereopa Edwards at [Tenancy address suppressed] is terminated, and possession is granted to [The landlord/s], at 5.00pm on Sunday 10 September 2023.

Reasons

Both parties attended the hearing, the tenant by phone and the landlord’s representative in person.
The landlord has applied for termination of the tenancy, rent arrears, refund of the bond and the filing fee.
The hearing today was by way of rehearing. Due to an error by MSD the tenant’s rent fell into arrears. Proof of that error was provided to the landlord today.
The tenant said she wanted her tenancy to end so I have made a consent order terminating the tenancy.
Because the tenant is currently away from Christchurch, I have granted the landlord possession this Sunday. That allows time for the tenant’s family members to remove her goods from the property.
The landlord provided the new security code for the premises to the tenant today so her family members can access the premises.
There is a rent credit. The tenant will remain liable for rent until Sunday 10 September.
The landlord has other costs to claim from the tenant including the filing fee on the warrant for eviction and the cost of lock replacement following the initial order. Some costs, such as airfares to attend the hearings, cannot be claimed.
The additional costs the landlord has, including any costs for the repair of damage and for cleaning, can be part of a new application.
If there is another application by the landlord for costs, the filing fee on this application can be included. There is little point in the Tribunal making an order for $20.44 now.
The landlord applied for, and is entitled to, an order for name suppression.
