- This order amends the monetary order made by the Tribunal on 14 June 2023 under this application.
Reasons
- The hearing was held by teleconference. Both parties attended the hearing.
- The landlord has applied for termination of the tenancy and rent arrears.
- On the evidence provided by the landlord, I am satisfied the rent was at least 21 days in arrears on the date the application was filed. The landlord has proved its claim for termination. The tenancy is therefore terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- In these circumstances, it is often standard for termination to be immediate. However, taking into account the tenant’s personal circumstances, the landlord has extended termination to Sunday 18 June 2023. It is sensible and appropriate to include an award for all rent owing to that date.
- The landlord provided rent records which prove the amount owing.
- As the landlord has wholly succeeded with the claim, I must order the other party to reimburse the filing fee and grant suppression of the landlord’s name and identifying details.
- This order amends the monetary order made by the Tribunal on 14 June 2023 under this application, as requested by the landlord. In all other respects, the order dated 14 June 2023 and the reasons given remain the same.
