Reasons

Both parties attended the hearing together with representative from a property management company named as the landlord in the application.

The tenant was (understandably) confused about who her current landlord is. I suggested that the hearing proceed as a directions conference only, but the parties reached agreements, so the Tribunal was able to make consent orders.

The Tribunal is satisfied that the landlord is the owner of the premises, and it has made a declaration to that effect.

The tenant confirmed that she has no claims against the property management company that was the landlord initially before the owner became the sole landlord.

The parties agreed that the tenancy, a fixed term tenancy to 29 September 2023, will now end on 2 August 2023.

The landlord offered, and the tenant accepted, compensation equivalent to 3 weeks’ rent in full settlement of the matters raised in the application which concerned the alleged failure to maintain the premises and to fully complete repairs.

Because the tenancy will end in 3 weeks’ time, the tenant accepted that the Tribunal cannot make work orders for work she states has not been completed.

The compensation agreed to will take the form of a rent waiver between now and the end of the tenancy. This means that the tenant need not pay rent for the next 3 weeks.

The bond will remain at the Bond Centre until the end of the tenancy. Provided the tenant complies with her statutory responsibilities when she vacates the tenancy, the landlord will agree to the bond being refunded to her in full.

If a bond dispute arises, the landlord will need to make an application to claim costs from the bond not agreed to.

The tenant is not liable for any damage to the premises done by any unknown third party.
