Reasons
- Both parties attended the hearing.
- The greater part of the Tenant’s application was heard, and the parties took some time to privately discuss whether matters could be resolved.
- The parties reached full and final agreement concerning the issues in dispute.
- The parties have asked me to record their agreement in a binding Tribunal Order.
- The parties have acknowledged errors were made on both sides and, importantly, the apologies which were made, each one to the other, have been wholeheartedly accepted.
- The Landlord has agreed to refund a portion of the rent as part of this agreement, on account of the Landlord’s claim of interference with his and the other tenants’ quiet enjoyment.
- This Order constitutes a legally binding, comprehensive agreement addressing any current or future claims that tenants, who did reside concurrently with the Applicant at the premises, may have or might have pursued against the Landlord. [The tenant/s] claims and has obtained settlement on their behalf.
- There is little public interest in an outcome reached by consent with no judicial determination being passed. Consequently, I order suppression of the names and identifying details of both parties.
