[The tenant/s] to pay [The landlord/s] $550.00 from a rent credit held by the landlord, by way of compensation for cleaning costs at the end of the tenancy.
The landlord is to pay the balance of the rent credit to the Bond Centre.
The Bond Centre is to release any money held in relation to the premises to the Estate.

Reasons

Only the landlord attended the hearing today.
This is a tragic case. [The tenant/s] was the sole tenant, and the evidence is that she died in the premises. After [The tenant/s] was found, extensive cleaning was needed. I have considered the invoice presented, which was for $6,749.01 of commercial cleaning costs. The majority of that cost has been paid by the insurer, but the landlord seeks an order to the sum of the excess, which is $550.00.
The landlord advised there is a rent credit held, which arose because of a continuing automatic payment following [The tenant/s] death.
In the circumstances, it is sensible that the landlord hold $550.00 of the rent credit to compensate for the cleaning costs not covered by the insurance excess.
The landlord advised that the rent credit is $1,984.20. Once the cleaning is deducted ($550.00), then the credit becomes $1,434.20. It is sensible to order that remaining credit be paid into the Bond Centre.
The Bond Centre may release any funds held for these premises to the Executor, or a person that the Bond Centre is otherwise satisfied is an appropriate representative of the late tenant.
