Order
- An application for suppression has been made in this case, and the Tribunal orders suppression of the Landlord’s name and identifying details because the landlord was substantially successful with the claim.
- Ryan Kerapa and Marie Iti must pay [The landlord/s] $159.44, being rent arrears of $139.00 and the filing fee of $20.44.
- The arrears are to be paid by payments of $20.00 per week over and above normal rent commencing before 30 August 2023 and then every week after that until the $139.00 is paid. There will be 6 payments of $20.00 and a final payment of $19.00.
Reasons
- The tenant did not appear. The landlord has applied for rent arrears and termination of the tenancy.
- The amount of arrears is not sufficient to terminate the tenancy. However the tenant needs to know that the landlord can apply for termination again and if within a 90 day period the rent is more than 5 days in arrear on three occasions, the tenancy could be terminated. See section 55(1)(aa).
