This matter was originally set down for hearing on 29 June 2023. The tenant was unable to attend in person and so she was telephoned. Having heard from both parties, I made the following directions which were recorded in a minute of the same date:

The tenant’s case is currently based on hearsay evidence. In order to make any findings of fact regarding the presence of asbestos and the drilling of holes and possible disturbance of asbestos, Ms Morris will need to provide: a. Evidence of asbestos testing by an independent asbestos assessor; b. Statements from the electricians involved about the work undertaken including whether any holes were drilled; c.Statements from her son about what he saw of the work undertaken; d. Photographs of the meter box would also be of assistance.

She must file any further statements must be filed by 20 July 2023 and copies sent to the landlord.

The landlord must file any response and send copies to the tenant by 27 July 2023. The documents produced at today’s hearing will be uploaded to the file.

All witnesses must also be available to answer questions at any hearing of the claim. If need be, that can take place by telephone, rather than have the witnesses attend the courthouse

Today the tenant was unable to attend in person and so she was telephoned. The landlord attended in person.

The tenant said that she had not filed the evidence because she had not been able to get a response to emails.

As noted in my minute of 29 June, the onus is on the tenant to establish her claim. She must provide evidence to persuade the Tribunal on the balance of probabilities that: a. There is asbestos in the power board b. The asbestos has been disturbed.

The tenant has been given an opportunity to substantiate her claim but has not done so.

The application is dismissed.
