The landlord must promptly email the completed HHSR to the Tribunal at aucklandmetrotenancy@justice.govt.nz (referring to the application file numbers 4602773, 4612769), for uploading to the Tribunal’s files.

If the HHSR identifies noncompliance with any of the HHS, the landlord must remedy the noncompliance by 18 March 2024.

If the HHSR identifies any noncompliance as mentioned in clause 5, the landlord must email the Tribunal by 19 March 2024 (see clause 4 for email details), with evidence that the noncompliance has been fully remedied, for uploading to the Tribunal’s files.

The landlord produced a Healthy Homes Standards report dated 2 February 2024 confirming compliance with the HHS. The HHS inspector, Matthew spoke to the Tribunal by telephone. He confirmed that he is qualified assessor, and he found the home was substantially compliant except for the heating standard.

The landlord says he achieved compliance by installing a panel heater. He provided Healthy Homes Inspections NZ Ltd, with evidence of the installation and it issued its report based on Matthew’s report and the landlord’s evidence.

The landlord says he emailed the HHS report to the Tribunal and cannot explain why it was not uploaded to the file.

I am not satisfied the landlord has not substantially complied with the Tribunal’s order. The main purpose of the HHS terms was to ensure that the premises were made compliant with the HHS for future tenants. The landlord has provided adequate evidence to confirm the premises do now comply with the HHS.

That is the end of the matter. A rehearing is not required.
