Order

An application for suppression has been made in this case, and the Tribunal orders suppression of the tenants’ names and identifying details.
The Bond Centre is to pay the bond of $2,760.00 ([Bond number suppressed]) to [The tenant/s] immediately.
The application for compensation and/or exemplary damages is withdrawn.

Reasons

One of the tenants attended the hearing. The landlord did not attend. The Tribunal understands that he is overseas.
The tenants have applied for a refund of their bond and for compensation and/or exemplary damages for the alleged failure by the landlord to repair the premises.
Yesterday, the landlord sent the Tribunal a statement of costs he wanted from the bond.
There is no landlord application before the Tribunal so the landlord’s claims cannot be addressed – see section 22B(2) of the Residential Tenancies Act 1986 (RTA).
In the absence of a landlord application, the tenants are entitled to their bond in full.
The tenant withdrew the application for exemplary damage and/or compensation for alleged breaches by the landlord.
If the landlord makes an application for costs from the bond, the tenants can file a cross application for the compensation and/or exemplary damages they seek.
I have not made an order for reimbursement of the filing fee as the dispute between the parties should now be at an end.
If there are further applications, the tenants can seek the payment of the filing fee on this application then.
The tenants sought, and are entitled to, a name suppression order as their application is successful – see section 95A RTA.
