The landlord served the tenant with notice of a breach of section 40(1)(c) of the Residential Tenancies Act 1986 on 11 May 2023.

In the notice, the landlord said they were disappointed with the condition of the premises including carpet stains, splatters on the kitchen floor and missed items of general cleaning. The issues noted previously for the attention of the publicly funded cleaner provided by the Ministry of Health had not been addressed.

The landlord also expressed concern about clutter, the amount of belongings collecting in the garage, and the risk that this could become a fire hazard or attract pests.

The landlord performed an inspection on 21 August 2023. The inspection report noted that no improvements had been made.

Tenants have an obligation to keep premises reasonably clean and reasonably tidy. The tenant is elderly and is provided with some publicly funded support with domestic tasks such as cleaning. However, concerns were expressed at the hearing that although the tenant should be getting 2 hours of cleaning assistance, the allocated cleaner is providing less than this.

The parties discussed and agreed that the landlord shall give 24 hours’ notice of entry for a professional cleaner (appointed by the landlord) to provide 1 hour of cleaning each week for the next 2 weeks at a cost of $45.00 plus GST per hour, payable by the tenant. The precise timing can be discussed between the parties. I have tried to leave the arrangements open in terms of the date and timing.
