This was the second hearing of this matter. The landlord has attempted to locate the tenant by visiting an address he had been given, but the tenant was not there.

The tribunal asked the landlord to produce evidence of the damages claim (as previously directed) and he produced a handwritten invoice on a printed form for water charges, where he has calculated the alleged use of the tenant by hand, using a formula. He said he received no water bill relating to the tenant’s residence as one Watercare bill covers 6 premises at the one location. He claimed other adjudicators have granted him water arrears based on such handwritten documentation alone but I indicated that sort of documentation on its own was inadequate.

He then claimed he has had to recarpet the property. I asked for evidence, as none was on file. He supplied a bank statement. I explained the need to prove, by before and after photos and other documentation, the damage caused by the tenant to the carpet and why the need for recarpeting.

At this point he said he would withdraw the claim.

The tribunal gave him the opportunity to seek an adjournment to get his documentation in order but he declined. Before leaving the hearing room he said he wanted the handwritten water invoice and the bank statement back, and so these were given to him.

Based on all the material provided, I would not have granted him any orders for damages.
