Section 22B(2) Residential Tenancies Act 1986 provides that, where a tenant applies for refund of the bond, and the landlord seeks payment from the bond, the landlord must file an application setting out the details of the counterclaim. Because the landlord has not filed a counterclaim the bond is refunded in full to the tenant.

For completeness, the landlord’s proposed claim related to the letting fee charged by her agent to re-tenant the property following the early termination of the tenancy. The tenancy was initially due to end on 17 January 2024.

The tenants sought to end the tenancy early as they purchased a house. They accepted that they would need to pay rent until the end of the tenancy or until new tenants could be found.

The landlord agreed to seek new tenants and the tenancy ultimately ended on 4 June 2023. The new tenants are paying $40.00 per week more than these tenants.

The landlord wanted the tenants to pay the $813.50 letting fee charged by the Agent for the re-letting.

That landlord’s claim would be difficult to prove given she has re-tenanted the property for more rent than this tenancy. As I discussed with the parties at the hearing, this new rent would mean that the landlord will receive $1302.86 more rent than she would have had this tenancy continued. On that basis, it is hard to see what loss the landlord has suffered.
