Reasons
- Both parties attended the hearing. [The landlord/s representative] represented [The landlord/s].
- Both parties filed multiple claims against each other with the Tribunal however, resolved their grievances by way of an agreed order on the hearing day.
- Accordingly, by consent I make the following orders: a. The tenancy ended on 31 July 2023. b. [The tenant/s] owes [The landlord/s] $13,500 in rent arrears. c. [The landlord/s] owes [The tenant/s] $3,500 by way of exemplary damages for various breaches of the Residential Tenancies Act 1986 relating to the bond and the Residential Tenancies (Healthy Homes Standards) 2019. d. The bond is to be transferred to [The landlord/s] in part payment of the debt. e. The remaining debt of $8,500 is to be paid by [The tenant/s].
- It was noted that [The tenant/s] will seek assistance through Work and Income New Zealand (WINZ) to pay the debt. Any part of the debt that WINZ does not pay, [The tenant/s] will pay off at a rate of $20 per week each Wednesday.
- The parties are to be commended for their pragmatic approach to resolving their disputes over what has been a difficult time for all.
