Reasons
- Both parties attended the hearing which was held by teleconference.
- This is a somewhat unusual situation where the tenant, [Tenant 1] was living with her partner, [Tenant 2], named on the tenancy agreement as a co-tenant. [Tenant 2] moved out and [Tenant 1] moved out some considerable time later in April 2023.
- [Tenant 1] was refunded half the bond money ($960.00) by the Bond Centre but the Bond Centre refused to refund her the other half. She now makes a claim for the remaining $960.00.
- I am ordering the Bond Centre to refund the remaining $960.00 to [Tenant 1]. I do so because the landlord makes no claim against the bond, and because I accept [Tenant 1]’s evidence that when he left he advised her that she could have the entire bond and in exchange he would take the car. I consider this to be an enforceable agreement between them.
- I am also ordering suppression of both parties’ names as per the provisions of 95A Residential Tenancies Act 1986. C ter Haar 21 August 2023
