Order

Reasons
- The hearing was conducted remotely. The tenant attended. Two calls to the landlord went to an answerphone.
- The tenant has applied for a refund of the bond of $950.
- The tenancy began in 2014 and ended on 10 April 2023. The tenant messaged the landlord to see if he wanted to meet at the property for a final inspection but he did not.
- Since the then the tenant has messaged the landlord several times about the bond. He said he was handing it over to a company. She had enjoyed a reasonable relationship with the landlord throughout her tenancy and so she was reluctant to have to bring a claim to the Tribunal.
- The tenant told the landlord she would simply contact the Bond Centre to have it released but she then discovered it has not been lodged.
- The tenant has no receipt or bank records (she has since changed banks), but she said that she paid two weeks in advance plus the bond of two weeks. The weekly rental was $475. She wants a refund of her bond of $950.00.
- Although the tenant had no documentary evidence to support her claim, in the absence of any evidence to the contrary, I am satisfied that it is more likely than not that she paid the landlord a bond of $950 and he has not refunded it to her. He is ordered to reimburse the bond of $950 to the tenant.
- Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee.
