The tenancy of [The tenant/s] at [Tenancy address suppressed] is terminated, and possession is granted to Auckland Property Management Limited As Agent For Zhang Family Trust, at 11.59pm on Sunday 8 October 2023.

Reasons

Both parties attended the hearing. Ms Craig and Ms Michie represented the landlord. [Tenant 1] attended for the tenants.
The landlord has applied for termination of the tenancy, rent arrears, water charges and payment of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The Tribunal can therefore terminate the tenancy. See section 55(1)(a) Residential Tenancies Act 1986.
The rent has been brought up to date and the water charges have been paid.
The parties agreed that the tenancy should be terminated, and possession given after 6 weeks. I have extended that slightly to give the tenants the weekend at the end of the period.
The tenants gave a good explanation for why there were arrears and I have given them name suppression because the negative effect on them otherwise would be out of proportion to the public interest in publication.
The landlord has succeeded and so the tenants must pay the filing fee.
