Mr and Mrs Cheriton were telephoned on all three of their phone numbers a number of times, with seven calls in total. None of the calls were answered and all rung out. Mr Cheriton had specifically requested to attend the hearing by telephone and was advised of the time and date last week. Unfortunately, as the Cheritons did not make themselves available for the hearing, it had to continue in their absence.

The hearing today had been scheduled to facilitate a conversation between [The applicant/s] and Mr Cheriton at Mr Cheriton’s request. The issues for resolution were the rent arrears and the fact that an inspection had not been able to be conducted since 2020.

The Tribunal had advised Mr Cheriton that should he engage sufficiently with his landlord after the last hearing, the proceedings could be withdrawn. Unfortunately, he has not done so. The only communication [The applicant/s] has had from Mr Cheriton was a request to halve his rent arrears debt.

Mr Cheriton has not engaged with the Tribunal or his landlord after specifically requesting further opportunity to do so. The landlord’s application for termination therefore remains. The evidence available to me demonstrates that the Cheritons have not paid their rent since July 2023, and they have not allowed their landlord access to the property for a number of years. These are breaches of their tenancy agreement and the Residential Tenancies Act 1986.

In the circumstances, I consider it appropriate that the conditional termination order I made on 18 October 2023 remain to deal with the situation. Therefore, if Mr Cheriton does not pay the debt in accordance with that order, the landlord is entitled to terminate the tenancy.

Given the tenancy is now in jeopardy, I decline to deal with the issue of access as it may now be redundant. However, should the tenancy continue, [The applicant/s] may apply for further orders regarding access on an urgent basis. All applications should be directed to me, and I will case manage the situation going forward if it is needed.

[The applicant/s] have applied for suppression and as they were successful in their application, I must grant that.
