Both parties attended the hearing which was held remotely by teleconference.

[The applicant/s] seeks $500 from the bond as rent for the last week of the tenancy. Mr Brennan does not feel he should have to pay that rent as he had been evicted from the home, his flatmates had moved out, he feels he was treated appallingly by the landlord and the Tribunal, and the landlord owes him money rather than the other way around.

The tenancy has a protracted history. In summary, it commenced in 2019 and on 15 November 2022 after a Tribunal hearing 1 it was terminated effective 18 November. Mr Brennan applied for a rehearing which was heard but declined, and the termination date was moved to 20 December.

Mr Brennan did not vacate, and an eviction warrant was obtained and was to be executed on 1 February 2023. Further discussions between the Police and the parties resulted in the last day Mr Brennan had possession of the house being 11 February.

Mr Brennan had paid rent regularly with his last payment being 26 January, which took him to the end of the rental week of 2 February. This claim therefore relates to the week 3 to 9 February which in itself is a reduction of two days. The amount sought is $150 less than the actual rent for the week on the basis of a previous Tribunal order that had reduced the rent by $10 a week but the full amount had been paid.

The amount of $1,420.44 directed by the order on 15 November has already been enforced by way of an attachment order and therefore is not sought by the landlord from the bond.

Mr Brennan feels aggrieved by the entire situation. As discussed with him at the hearing, I can only make an order today on the claim that is before me, which is the rent for the last week. As he was in possession of the property for that week, he is required to pay rent for it. I appreciate that he did not want to be there and feels the termination was unjust, however that order stands.

As also discussed with Mr Brennan, if he does not agree with a Tenancy Tribunal Order he can appeal that to the District Court. If he feels there are breaches of the law or his tenancy agreement by the landlord that have not previously been the subject of an application to the Tribunal, he is entitled to make a further application.

[The applicant/s] was successful in his application therefore he is automatically entitled to suppression. Mr Brennan was not, and therefore his details are to be published.
