Both parties attended the hearing. The tenant attended with a support person in attendance.

There was initially some difficulty contacting the landlord but the landlord was eventually able to join the hearing and present submissions.

The landlord has applied for rent arrears and has provided rent records which prove the amount owing.

The landlord’s evidence was that rent has not been paid since September 2020. The rental arrears are exorbitant. The landlord is not, however, seeking termination, as it is entitled to; it is only seeking an order that the rent arrears be paid.

The tenant has previously had an adjournment of this matter on the basis of health issues. She attempted to get the hearing set down for today likewise adjourned, also on medical grounds, although no medical evidence was submitted. She submits that she needs a hearing first thing in the morning because she starts to deteriorate as the day wears on. This hearing had commenced at 10.45, which she said was too late for her.

I was satisfied that the tenant understood everything that was taking place during the hearing and she presented her case with clarity and respectfully.

The tenant was unable to articulate any reason why the rent should not be paid and said that she had in fact send a letter to the landlord stating that she would be paying the rent. She hopes to be able to pay the rent from an inheritance she is due, although, in exploring that topic with the tenant, it became clear that the inheritance is tied up with a property that another beneficiary has a right to occupy. It seems that the money due from that inheritance will therefore not spring forth anytime soon. The tenant will need to make alternative arrangements to pay off the arrears.

For completeness I mentioned that the tenant submitted that she wishes to file a cross application. She has previously mentioned wanting to file a cross application but to date has not done so. If she wishes to file a cross application there is nothing stopping her from doing that but she will need to do so separately.

Because [The landlord/s] has wholly succeeded with the claim I must reimburse the filing fee. As it has succeeded, I exercise the discretion to suppress its name.
