Both parties attended the telephone hearing today.

The landlord has applied for possession of the premises following termination of the tenancy. On 3 May 2023 the landlord served a 90-day notice of termination on the basis that the landlord intends to carry out extensive renovations.

Pursuant to the notice, the tenancy ended on 2 August 2023 which is less than 90 days ago. The requirements of section 64(1) of the Residential Tenancies Act 1986 (the Act) are satisfied.

However, the tenant has had difficulties finding suitable replacement accommodation. The landlord is willing to extend the possession date.

After discussion the parties agreed that the tenancy will end at midnight on 12 October 2023 and the landlord will be entitled to possession. The tenant may give 2 weeks’ notice to terminate the tenancy earlier if she finds accommodation sooner. The parties may also, by agreement, accept the surrender of the tenancy by the tenant at any time before 12 October 2023.

It is appropriate, in the specific circumstances of this case, to vary the usual notice requirements in section 51 of the Act, which require the tenant to give 4 weeks’ notice of termination. The tenant is actively looking to move out and may be able to do so several weeks ahead of time. A shorter notice period still gives the landlord the notice they require to finalise the scope of the renovation works and plan for their commencement. I have varied section 51(2B) of the Act pursuant to section 77(2)(j) so that the tenant may give 2 weeks’ notice to terminate.

The landlord has substantially succeeded with the claim. I have therefore reimbursed the filing fee.
