Trio Rawiri and David Fotualii must pay [The landlord/s] $124.91 immediately, being rent arrears owing as at today.
Trio Rawiri and David Fotualii must pay [The landlord/s] $20.44 immediately, being the filing fee.
Trio Rawiri and David Fotualii must pay [The landlord/s] the weekly rent on a Tuesday, with the next weekly rent payment falling due on 3 October 2023.

Reasons

Only the landlord attended the hearing. Phone calls placed to the tenants went through to voicemail.
The landlord has had difficulty with the tenants failing to regularly pay rent in advance on the weekly rent date and often paying different amounts.
The tenant’s view is that they are not required to pay rent in advance and that they pay rent in arrears.
At one point, there was a conditional mediated order to change the rent payment date, however, that was breached because the tenants did not pay the rent that was then outstanding, which the landlord said it was a condition of the mediated order.
The tenancy agreement provided that the first rent payment date would be 5 January 2021, a Tuesday. Thereafter, rent was agreed to be paid on a weekly basis.
The rent payment date is therefore a Tuesday and rent must be paid on that date.
The landlord has produced evidence that satisfies me that the rent owing as at today's date is as ordered above, with the next rent payment falling due tomorrow, 3 October 2023.
Because [The landlord/s] has substantially succeeded with the claim I have reimbursed the filing fee.
