The Tribunal orders suppression of both the Landlord and Tenants’ names and identifying details.

Reasons

Both parties attended the hearing. [Tenant 1] and [Tenant 2] appeared on behalf of all of the tenants. [Property manager] represented the landlord.
The tenants have filed the following claims in the Tenancy Tribunal: a. Compensation for disposal of items stored at the property prior to the commencement of the tenancy; b. Exemplary damages for failure to provide a copy of the signed tenancy agreement; and c. Exemplary damages for the landlord requiring payment of rent more than two weeks in advance.
This is an ongoing tenancy which is currently on a fixed term until 31 December 2023. At the hearing it became apparent that the parties had not had the opportunity to discuss and try to resolve the claims. In addition, there appears to be confusion about the payment of rent as the tenants advised that the landlord says that they are in arrears but they do not agree.
I discussed matters with the parties. This is an ongoing tenancy. The parties agreed that there would be a benefit in them attempting to resolve their issues by agreement. In the circumstances I have made an order referring this matter to mediation.
If the parties cannot reach agreement at mediation then a further hearing will be scheduled before a different Adjudicator.
If possible, the mediation will be held in person rather than by phone.
As the parties have agreed to attend mediation I have exercised my discretion to suppress their names and identifying details. If the matter proceeds to a hearing then the issue of ongoing suppression will be a matter for the Adjudicator who determines the tenants’ claims.
