The Tenant, after several adjournments, requested by her, for various reasons, did not turn up to this rehearing which was granted following what the previous adjudicator termed a ‘line call’ in response to her rehearing application, which the Landlord described as a continuation of the Tenant’s longstanding delay tactics.

There have been three adjournments, a hearing, rehearing consideration and a rehearing – I consider each will have required the Landlord to set aside at, a very minimum, 5 hours for each hearing day. If he is to be compensated at a rate of $35/hour for his attendance, which is a standard rate for cleaning and handyman work, $750 is his total opportunity cost, and his direct loss. (I note there were proceedings before this, at which the Tenant was presented with opportunities to make good on her covenant to pay the rent.)
The award serves not only to recompense the Landlord for their unrecouped investment in the process but also underscores the principle that parties should bear the costs of their actions that result in unnecessary procedural extensions and complications.
Such an award is in keeping with the broader objectives of fairness and efficiency in dispute resolution, ensuring that the burden of undue process is appropriately allocated.
