An application for suppression has been made in this case, and the Tribunal orders suppression of the landlord’s name and identifying details.
The tenancy of Alex Kaaho-Rewiti at [Tenancy address suppressed] is terminated, and possession is granted to [The landlord/s], at 11.59pm on Sunday 24 September 2023.
Alex Kaaho-Rewiti must pay [The landlord/s] $20.44 immediately being the filing fee on this application.

Reasons

Both parties attended the hearing which I conducted by phone. The tenant was supported be her representative.
The landlord applied to terminate the tenancy based on a breach by the tenant not capable of remedy – the use of the premises for an illegal purpose.
The tenant then gave 28 days’ notice to terminate the tenant. Based on that notice, the tenancy would end on 1 October 2023.
More recently, the tenant sent the landlord a threatening text message. Today, the tenant apologised for that.
The only issue for the Tribunal to determine is when the tenancy should end.
The landlord sought possession this Friday.
I have granted the landlord possession at the end of the day on Sunday 24 September 2023. That is a more realistic timeframe for the tenant to vacate the premises.
The possession order is based on the breach not capable of remedy and the more recent email threat made by the tenant which, in the absence of the notice to end the tenancy given by the tenant, would have justified an order terminating the tenancy under section 55(1)(c) of the Residential Tenancies Act 1986 (RTA).
The landlord applied for a name suppression order and is entitled to that as the application is successful – see section 95A RTA.
As the application is successful, the tenant must pay the landlord’s Tribunal filing fee.
