The tenants must pay the weekly rent of $480.00 (subject to any change in the rent properly payable) on Wednesday 25 October 2023 and on each Wednesday thereafter during the term of the tenancy.

If, within the period of 3 months from the date of this Order the tenants fail to make any payment of the weekly rent within 2 working days of the due date: a. The tenancy at 249 London Street, Tawhero, Whanganui 4501 will terminate and the landlord will have immediate possession of the premises. b. Any arrears will be payable immediately.

The tenants must pay the landlord $20.44 being the filing fee on this application.

Reasons

Both parties attended the hearing which was held by teleconference. Ms Hema appeared for the tenants.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.

The tenants want to maintain the tenancy and avoid immediate termination.

The landlord’s application is made on the grounds that the rent was 21 days in arrears on the date the application was made (s.55(1)(a)) and on the grounds that the tenants did not comply with 3 rent arrears notices given within a 90 day period (s.55(1)(aa)).

As at the date of hearing all arrears have been paid and the rent is paid in advance to 24 October 2023. The tenant says that the landlord can be assured of continuing regular rent payments as she now has work to ensure the rent can be paid on time.

The landlord nevertheless asks for the tenancy to be terminated due to the inconvenience and difficulty caused to the owner and property manager by irregularity in the rent payments.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986. The grounds for termination under s.55(1)(a) and 55(1)(aa) are met.

I am satisfied however that the tenants should be given a final opportunity to demonstrate their willingness and ability to consistently pay the rent when it is due. Ms Hema says she understands the problems caused when the rent is not paid on time and is in a position to ensure no future breaches. I have granted a conditional termination order.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.

Because the landlord has succeeded with the claim I must reimburse the filing fee.
