Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

The tenant has breached their obligations by failing to keep the premises reasonably clean and tidy.

The landlord served multiple 14-day notices on the tenant, and the tenant did not remedy the breach within the required periods.

The tenants have failed to comply with six 14 day notices, the most recent notice is dated 13 October and gives the tenant until 31 October to comply.

Each of the notices relates to the tenants’ failure to keep the premises reasonably clean and tidy.

The photos and inspection records show that the premises are cluttered, mouldy and unkempt. There are carpet stains, mould on window frames, rubbish and lawns strewn, scribbled walls, ripped wallpaper, hole in kitchen walls not repaired, unclean oven and warming drawer, dirty cupboards, laundry full of clothes, sink blocked, untidy and unmowed lawns, stains on lounge floors, and dirty toilet and shower.

It would be inequitable to refuse to terminate the tenancy in the above circumstances.

Because D & M Properties 2006 Limited As Agent For P & S Burridge has wholly succeeded with the claim I must reimburse the filing fee.
