Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
The landlord provided the following evidence: a. On 24 March 2023 the landlord became aware that the tenant had left the property three weeks ago as she was applying for rental assistance in Auckland. b. On 12 May 2023 the tenant’s sister told the landlord that the tenant was living in Auckland. c. On 12 May 2023 and 28 July 2023 notices were delivered to the property requiring her to return and occupy the property. d. The property was visited by the landlord on 14 August 2023 and was advised by the unlawful occupants at the property that the tenant had gone to Auckland. e. A property inspection was undertaken and a report prepared on 28 August 2023 confirming that the unlawful occupants had left the property, that it was unlocked and it appeared that there was nobody living at the property.
I am satisfied that on 28 August 2023 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises.
Because the premises have been abandoned and rent is in arrear, the tenancy is terminated immediately.
