Order
- Monique Cowie owes Prime Property NZ Limited and Herry Kumala $1,980.00 being rent arrears for the period ending Tuesday 31 October 2023 (“the debt”).
- Monique Cowie will pay the debt by minimum weekly payments of $60.00 commencing on Wednesday 8 November 2023 and continuing every Wednesday until the debt has been paid in full. These payments are in addition to normal weekly rent of $590.00 (making the total to be paid each week $650.00). The next payment of normal weekly rent is due on Wednesday 1 November 2023.
- Payments made will be allocated first to rent and then to the debt.
- If Monique Cowie fails to pay rent and the debt as set out in clause 2 above within 2 working days of the due dates: a. The tenancy at 60C Seymour Road, Sunnyvale, Auckland will terminate and the landlord will have possession of the premises on the date given in a written notice from the landlord. b. The balance of the debt will be payable immediately.
Reasons
- Both parties attended the hearing, which was held by way of teleconference, and agreed to the terms of this order. Mr Peterson represented the landlord.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach: section 64(4)(b) of the Residential Tenancies Act 1986.
