Order
- BY CONSENT – the mediator’s order for application 4649612 sealed on 7 September 2023 is amended.
- I find the amount of rent owed for the last week of the tenancy is 5 days of rent up to and including Tuesday 12 September 2023 in the amount of $510.71.
- The tenant should pay $510.71 to the landlord immediately.
- The claim for compensation is withdrawn.
Reasons
- Both parties attended the hearing.
- The parties agree the mediators order can be amended because the tenant moved out on 11 September 2023, instead of 14 September which was the date specified in the mediator’s order. I find I can make this order by consent. See section 85 Residential Tenancies Act (RTA).
- The inspection was done on 12 September. I find the last day of the tenancy was 12 September 2023 and the tenant should pay rent for this day as well.
- Should the landlord need to file an application with the Collections Team because tenant does not pay the money owed then this order should be given to the Collections team, along with the original mediated order.
- I allow suppression for both parties because the orders were made by consent and it was expeditious to hear the matter and make an order rather than refer the parties back to mediation. See section 95A RTA.
- Given that the landlord has agreed to an amount less than in the mediated order I make no order for reimbursement of the filing fee.
