[The tenant/s] must pay [The landlord/s] $14,994.29 immediately, being rent arrears to 24 January 2023.

Reasons

Both parties attended the hearing. The Landlord indicated the Tribunal had not made an Order for Termination at the last hearing when it should have done. The Tenant, who was not present at the first hearing claimed she did not receive notice of the hearing.
I was satisfied, in the end, the Tenants had received adequate notice of the hearing as they acknowledged receipt of the Landlord’s application by email on 10 October, well before the 7 November hearing date, but I was inclined to hear their explanation regarding the rent arrears anyway. The Tenants claim Work and Income refused to pay rent until the Landlord provided a Healthy Homes Statement concerning the property, which the Landlord did do on 10 October 2023.
The Tenant also claimed there were issues with the home, and I indicated she would have to bring a separate application. I was satisfied, having had a summary of her claims, that the probable quantum of any award in her favour would not have reduced the arrears, owing as of 7 November 2023, below the equivalent of 21 days rent.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated: s 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing at the end of the tenancy.
I grant name suppression to the Tenants on the basis they faced many personal hardships, many outside of their control, and publishing their names would adversely affect their chances of finding another rental property in [City], which would be disproportionate with their breach of rent covenant, which has ended in the termination of their tenancy and their displacement.
