Order

The tenant must carry out the following, which must be completed by 10 May 2024: a. Remove all dogs from the property.
If the tenant fails to comply with Order 1 above, then the landlord may undertake the work and charge the tenant the costs of this work up to $500.00. These costs may be treated as rent in arrears and enforced accordingly.

Reasons

Only the landlord attended the hearing. The tenant was aware of the hearing and advised the landlord of various reasons she could not attend. No communication or request for adjournment was received by the Tribunal.
The landlord claims that the tenant has failed to seek consent for pets as set out in the tenancy agreement. The landlord wants the problem fixed.
Under the Residential Tenancies Act 1986, a tenant has specific obligations in relation to the tenancy premises.
Where the Tribunal finds the tenant has failed to comply with any of these obligations, where appropriate it may make an order for the landlord to carry out the work.
A work order may also authorise the landlord to undertake the work and charge the tenant the costs of doing the work, if the tenant should fail to comply with the work order and alternative monetary order. A monetary limit must be imposed by the Tribunal on the amount of costs that can be charged. These costs can be treated as rent in arrears and enforced accordingly.

Has the tenant failed to comply with their obligations?

This matter was before me on 18 December 2023, and time was allowed for the tenant to seek consent to keep a dog (“Kingston”) at the premises, in accordance with the tenancy agreement. The tenant was also required to prove that Kingston was registered and de-sexed.
The tenant has not sought consent to keep Kingston, and the landlord believes there are now 2 dogs at the premises.
The tenant has not provided evidence that either dog is registered or de-sexed.
The landlord does not apply a blanket ban on pets at the premises, but does require an application for consent, and evidence that any dogs are registered, de-sexed and not on the list of dangerous breeds.
I consider these conditions are reasonable, and enforceable.
The tenant has had a significant amount of time to comply with the landlord’s requirements, and has failed to do so.
Accordingly, the landlord’s application for a direction that the dogs are removed is granted.
