Order
- [The tenant/s] owes Otautahi Community Housing Trust $392.30 (“the debt”).
- [The tenant/s] must pay rent and the debt as follows: a. By weekly payments of $160.00, being $150.80 for rent and $9.20 for the debt. b. Payments will be every Tuesday, with the next payment on Tuesday 12 December 2023 and continuing until the debt is paid in full.
- Payments will be allocated in the following order: rent, then rent arrears.
- If the tenant fails to pay rent and rent arrears within 2 working days of the due dates the balance of the debt will be payable immediately.
Reasons
- Both parties attended the hearing.
- The landlord has applied for rent arrears and has provided rent records which prove the amount owing.
- The conditional termination order will lapse if it is fully complied with.
- The order may be enforced as a monetary order.
- The tenant made an application for suppression. The Tribunal may, on the application of any party to proceedings or on its own initiative, having regard to the interests of the parties and to the public interest, order that all or part of the evidence given or the name or any identifying particulars of any witness or party not be published. See section 95A RTA.
- The tenant is not the most successful party, but I am using my discretion to allow suppression. The parties came to an agreement before the hearing and only required the Tribunal to formalise their agreement. I could have referred the parties to mediation – which is confidential – but it was expeditious to make an order because I had both parties on the telephone. Further I am not persuaded there is public interest in the tenant’s name at this stage.
- The landlord does not get suppression because there is public interest in the provision of social housing.
