Reasons

Both parties attended the hearing.
Following the end of her tenancy on 18/10/2023 the tenant sought compensation of $1,390.00 being the rent she had paid for the two weeks notice she had to give.
The tenant was unhappy that the landlord had appealed the previous Order of the Tribunal dated 7/9/2023 and cast doubt on the veracity of her evidence.
Due to personal circumstances and the belief she would need to go through the previous process again the tenant felt forced to urgently end what was then a fixed term tenancy.
In response, the landlord confirmed that the previous decision had been appealed but the appeal had been withdrawn after the tenant vacated.
The landlord submitted that while 28 days notice had originally been requested this had been reduced to two weeks and a refund of overpaid rent made.
The Tenancy Tribunal is a civil jurisdiction which means I cannot take the personal circumstances of any party into account, except in certain limited circumstances, which do not apply here.
While the tenant’s feelings are understandable in the circumstances she found herself in her claim for compensation fails.
The landlord was within their rights to file an appeal.
By subsequently withdrawing the appeal this means that the original decision remains in place, the tenancy was not terminated, and the compensation claim failed.
As the tenancy was for a fixed term the tenant could only end the tenancy with the agreement of the landlord, or if she applied to the Tribunal for a reduction in the term of the fixed term tenancy.
Eventually the parties agreed to end the tenancy with two weeks notice, which I consider was appropriate in the circumstances of the dispute between the parties.
Suppression is granted to both parties pursuant to section 95A(4).
