An application for suppression has been made in this case, and the Tribunal orders suppression of the Landlord’s name and identifying details.
Charlotte Mamaia owes [The landlord/s] $5,981.96 (“the debt”), being rent arrears as at today.
Charlotte Mamaia must pay the debt on or before 7 December 2023 by one lump sum.
If Charlotte Mamaia fails to pay the debt in one lump sum on or before 7 December 2023: a. The tenancy at [Tenancy address suppressed] will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
If the tenant fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.

Reasons

Both parties attended the hearing.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The tenant wants to repay the debt to avoid immediate termination.
Rent was at least 21 days in arrears on the date the application was filed. The landlord provided rent records which prove the amount owing at today.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
I am satisfied that a conditional termination is appropriate as ordered above. I note that this was ultimately agreed at the end of the hearing. The landlord’s reluctance was it said it has previously had to secure a conditional termination, which the tenant satisfied earlier in the year. The landlord’s concern is that the arrears are now even higher. The tenant however assured me that she would be able to have the arrears paid in full on or before 7 December 2023.
The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
The Tribunal can order name suppression when a party has been wholly or substantially successful in the proceeding. In this case the landlord has applied for name suppression and because the landlord has been substantially successful, name suppression is granted.
Because [The landlord/s] has substantially succeeded with the claim I have reimbursed the filing fee.
