Order
- No application for suppression has been made in this case and no suppression orders apply around publication of this decision.
- This order replaces the mediated order dated 2 nd October 2023 for rent arrears of $4,130.00 under TT 4675830.
- Gagan Maan must pay Noya Limited $1,700.39 immediately, calculated as shown in table below.
Reasons
- The landlord attended the hearing. The tenant did not.
- The landlord has applied for rent arrears, compensation, and reimbursement of the filing fee following the end of the tenancy. Background
- The tenancy ended on 7 th October 2023. There were two tenants for this property.
- On 2 nd October 2023, a mediated order was sealed confirming rent arrears of $4,130.00 under TT 4675830 against both tenants.
- The other tenant has already paid the half share of the rent arrears and compensation to the landlord. Therefore, the other tenant is not named in this order and this order is only made against Gagan Maan.
- The bond of $2,360.00 had already been released to the landlord to offset the amount owed by the two tenants.
How much does the tenant owe?
- The landlord has provided photos, rent summaries, water rates, cleaning and repair invoices to prove the claims for rent arrears of $4,130.00, lawn and rubbish removal of $150.00, cleaning of $440.00, glass replacement of $656.38 and water rates of $343.52. The total owed by the two tenants was $5,719.90.
- From that amount, the bond of $2,360.00 has been paid to the landlord. That reduced the balance owing to $3,359.90.
- The other tenant has paid the half of the amount owing to the landlord.
- That leaves $1,679.95 to be paid by Gagan Maan.
- I am satisfied that the landlord has proven the claims to the required standard.
- I order Gagan Maan to pay the landlord $1,679.95.
- In addition, as Noya Limited has wholly succeeded with the claim, Gagan Maan must reimburse the landlord’s filing fee of $20.44 also.
