Ms Campbell had two witnesses give evidence at the hearing. They were both present on 6 November when the tenant came into the office. They said he was very upset because he had not been paid a $100 rent rebate. He swore at people, acted aggressively and slammed the door when he left. Not long after he telephoned the office twice. He was put on speaker phone for these calls.

Witness 1 heard the tenant tell witness 2 that he would follow her home and rob her. The tenant threatened to burn down the rented house, smash up the office, and make the office disappear.

Witness 2 said in the phone call made to her the tenant threatened to burn down the house he rents. He said he would smash up the house he rents. He threatened to burn down the landlord’s office. He said he would follow witness 2 home and rob her.

A third person has written a statement. This person did not give evidence as a witness. Her written statement supports the evidence given by the witnesses.

A manager made the decision to lock the office down after these calls. Witness 1 called the police and they came and took things very seriously. The police left and went to the tenancy premises. As far as the landlord knows no charges have been laid.

This is the landlord’s claim to prove. I am persuaded by the evidence because: • I do not have any evidence from the tenant • three people working for the landlord heard the tenant threaten their safety • three people working for the landlord heard the tenant threaten to damage the house he is renting by burning it or smashing it.

I find the tenancy should end because of the breach of section 55(1)(b) and (c) RTA. The landlord has asked that the tenant be given two days to move out.
