- The tenancy of [The tenant/s] at 38 Cheshire Street, Cannons Creek, Porirua 5024 is terminated, and possession is granted to Raewar Trustees Limited Warwick Walbran, at 11:59pm on Monday 18 December 2023.
- The Bond Centre is to pay the bond of $1,400 (3541425-013) to Raewar Trustees Limited Warwick Walbran immediately.
- [The tenant/s] is to pay Raewar Trustees Limited Warwick Walbran $2,470.44 immediately in accordance with the following table:
Reasons
- Mr Walbran attended the hearing. There was no appearance for Ms Tindle however as she has been served with the notice of hearing, it continued in her absence.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed and is well in excess of that at the date of hearing. Accordingly, the tenancy must be terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at the end of the tenancy.
- Because Raewar Trustees Limited has wholly succeeded with the claim I must reimburse the filing fee.
