The application is dismissed.

Reasons

Both parties attended the hearing remotely.
The landlord has confirmed that the tenant has paid her rent up to date and there are no rent arrears.
Additionally, the tenant has complied with the notices that the landlord had issued on three separate occasions which were on 11 October 2023, 18 October 2023, and 27 October 2023.
Therefore, I refuse to terminate the tenancy under section 55(2) of the Residential Tenancies Act 1986 (“RTA”).
I have also informed the landlord that the notice he issued did not comply with section 55(1)(aa)(ii) as it failed to notify the tenant of her legal right to make an application to the Tribunal challenging the notice.
On this occasion, failure to comply with section 55(1)(aa)(ii) is not a relevant issue for me to consider because the rent is up to date. It may be a different outcome against the landlord if the rent is not current.
Given that the rent is paid to date, I dismiss the landlord’s application for termination of the tenancy. Filing fee
I decline to refund the filing fee as the landlord's application was unsuccessful. Suppression
I have decided to suppress the names and identifying information of both parties under section 95A(4) RTA for the following reasons: a. The tenant has brought her rent to date. b. Revealing her name could have a negative impact on her ability to find a new rental property in the future. A future prospective landlord may mistakenly assume she will not pay her rent. c. The landlord has applied for suppression. d. Since the parties have resolved the matter prior to the hearing, I do not see any public interest in this case.
