Reasons

The landlord attended the hearing represented by . There was no appearance for . As she has been served with the notice of hearing, the hearing continued in her absence.
The landlord has applied for termination of the tenancy pursuant to section 55(1)(b) of the Residential Tenancies Act 1986 (RTA). This is because on 19 November 2023 allegedly set fire to her bed in a suicide attempt. She subsequently left the property with the fire still going. The fire has substantially damaged the property and has been charged with arson.
If a tenant causes substantial damage to the property, the Tribunal must terminate the tenancy pursuant to section 55(1)(b) of the RTA unless satisfied that the tenant has remedied the breach and it is unlikely to undertake such actions again.
The landlord has established actions to the requisite standard in the Tribunal, that being the balance of probabilities. Accordingly, as has substantially damaged the property, I terminate the tenancy, effective immediately.
The landlord has applied for suppression, and pursuant to section 95A of the RTA I grant that as they were successful in their claim. I also direct that the tenant’s details are redacted given the mental health issues discussed in this decision.
