The Tribunal has no jurisdiction. The application is dismissed.

Reasons

Both parties attended the hearing which I conducted by phone.
The premises are owned by the respondent’s parents. The responded resided at the premises. The relationship between the parties was as flatmates.
Section 5 of the Residential Tenancies Act 1986 (RTA) excludes certain tenancies from the provisions of the RTA. The exclusion in section 5(n) applies: where the premises, not being a boarding house, continue to be used, during the tenancy, principally as a place of residence by the landlord or the owner of the premises or by any member of the landlord’s or owner’s family:
Because these premises were used principally as a place of residence by a member of the owner’s family, the tenancy is excluded from the provisions of the RTA.
Ms Cooper may file a claim in the Disputes Tribunal which has jurisdiction to hear and determine flatmate disputes.
The Tenancy Tribunal has no jurisdiction in this case.
The respondent sought a name suppression order. I grant that application as the defence to this application has succeeded.
