Both the landlord’s and the tenants’ claims are dismissed as the Tribunal does not have jurisdiction.

Reasons

Both parties attended the hearing. The tenants were assisted by a Korean interpreter.
The tenants have moved out of the property and seek recovery of their bond. The landlord has filed a cross claim seeking compensation for various damage and for additional rent that she says is payable after the tenants moved out.
The parties have signed a flat-sharing agreement rather than a tenancy agreement. The landlord is living in the property.
Section 5(1)(n) RTA provides that the Residential Tenancies Act 1986 does not apply: where the premises, not being a boarding house, continue to be used, during the tenancy, principally as a place of residence by the landlord or the owner of the premises or by any member of the landlord’s or owner’s family
The Tribunal does not have jurisdiction to hear the parties’ claims. The landlord is living in the property and the property is not a boarding house. The Disputes Tribunal is the appropriate forum for this dispute. The parties may wish to try to resolve matters between themselves, but if they are unable to do so, may elect to file their claims in the Disputes Tribunal.
As this Tribunal does not have jurisdiction to hear the claims I have exercised my discretion to suppress the parties names and identifying details as there is no public interest in publication.
