The tenancy commenced on 30 December 2019 and end on 24 October 2023. On 05 December 2023, the landlord filed a claim for cleaning costs of $368.00, repairs of $465.75, and painting costs of $1,897.50. At a telephone hearing on 05 July 2024, the tenant accepted the claims made for cleaning and repairs but disputed the painting claim. The Tribunal was invited by the parties to release a portion of the bond to cover the agreed claims and adjourn the remaining painting claim. Accordingly, the Tribunal recorded that the claims for cleaning and repairs had been accepted by the tenant and ordered release of $833.75 to the landlord. The hearing of the painting claim was adjourned, and evidence directions made.

On 09 July 2024, the matter was relisted for a telephone hearing today, 05 September 2024. Earlier this morning, the Registry received an email from the tenant advising that they would not be attending the hearing and that they had agreed to release the total bond to the landlord. Attached to the email was a completed bond form that the tenant stated had been sent to the Bond Centre.

The Tribunal’s view is that, by agreeing to release the balance of the bond, the tenant accepts the outstanding claim, at least to the amount remaining, which is less than what was claimed. The landlord agrees that this appears to be the case and has accepted this as resolution. Accordingly, I order that the balance of the bond be released to the landlord and record that all claims in the application have been resolved. Costs

The landlord does not seek reimbursement of the filing fee. Name suppression.

Section 95A of the Act provides that on the application of a party that has been wholly or substantially successful in proceedings, the Tribunal must order that the name or identifying particulars not be published, unless the Tribunal considers that it is in the public interest to publish the names of the parties, or is justified because of the parties’ conduct, or any other circumstances of the case.

I find that both parties have been successful to the extent that they are entitled to name suppression. Accordingly, an order suppressing the names of both parties is made.
