- This application is struck out for lack of jurisdiction.
Reasons
- This hearing was scheduled to be heard by videoconference. The tenant did not join the hearing and nor did he answer his phone either time that I called. The hearing therefore proceeded in his absence.
- The Tenancy Tribunal has the jurisdiction to hear only claims between landlords and tenants where the tenant is residing at the premises and the tenancy is subject to the provisions of the Residential Tenancies Act 1986.
- At the beginning of today’s hearing it was apparent that the subject of this claim was a lease of commercial premises at which the respondent is conducting his business. He is not residing there.
- I have therefore struck the matter out because this Tribunal does not have the jurisdiction to hear it. C ter Haar 21 February 2024
