The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrears at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

On 8 January 2024 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The landlord issued a 48-hour notice to inspect the premises on 5 January 2024 after the rent payments were overdue and the tenants were unable to be contacted.

At the inspection no one answered the door. The landlord found that the house had been used to cultivate drugs with most rooms used for this purpose. The Police were called and confirmed a large amount of drug cultivation. The tenants continue to be unable to be contacted by text email or letters.

The landlord provided rent records which prove the amount owing at today’s date.

Because the premises have been abandoned, and rent is in arrears, I am terminating the tenancy immediately.

All the requirements for an expedited abandonment application have been met. The tenancy of Pham Manh Thanh, Kieu Linh Dinh and Anh tuan Nguyen at 6 Pikitea Road, Mangere Bridge, Auckland 2022 is terminated, and possession is granted to [The landlord/s], immediately.
