The hearing was held today by teleconference. The director for the respondent was unable to attend due to being in liquidation. The representative managing the liquidation for the liquidators attended the hearing, but the applicant did not attend. The applicant was contacted several times on the contact number provided in the application but without success. I proceeded with the hearing in the applicant’s absence as I was satisfied that adequate service of the hearing notice had been completed.

The applicant has brought a claim against Counties Realty Ltd (trading as One Agency Counties Realty) in relation to their tenancy at 2249 Buckland Road, Buckland, RD4, Pukekohe 2694. However, Counties Realty Ltd is in liquidation. Section 248(1) Companies Act 1993 provides that no legal proceedings may be commenced against a company in liquidation without the consent of the liquidator or the High Court. The liquidator has refused consent and no application has been made to the High Court. In the circumstances, I have no jurisdiction to hear this claim until either the liquidator consents or the High Court orders otherwise.

The representative managing the liquidation for the liquidators noted that they do not dispute that the bond needs to be returned to the tenant. It was also indicated that a bond in the amount of $1,960.00 for the applicant’s tenancy had been found and it appears this may have been paid by the director to the Bond Centre, but this is still under investigation. In contacting the Bond Centre, I was advised that there was still no bond lodged for this tenancy as yet.
